The Decree of
No.162
The Administrative Provisions of Handan Municipality on the Civil Aerodrome Obstacle Free Space and Electromagnetic Environmental Protection which was adopted on the 13th executive meeting of Handan Municipal People’s Government on 10th of October 2017 , is hereby promulgated and shall come into force on 1st of December 2017.

on the Civil Aerodrome Obstacle Free Space and
Electromagnetic Environmental Protection
第一章 總 則
Chapter I General
第一條 為加強(qiáng)本市民用機(jī)場(chǎng)凈空和民用航空電磁環(huán)境保護(hù)管理，保障航空器運(yùn)行安全，根據(jù)《中華人民共和國(guó)民用航空法》《民用機(jī)場(chǎng)管理?xiàng)l例》《河北省民用機(jī)場(chǎng)凈空和電磁環(huán)境保護(hù)辦法》等法律法規(guī)，結(jié)合本市實(shí)際情況，制定本規(guī)定。
Article 1: In order to strengthen the administration of Handan Municipality on the civil aerodrome obstacle free space and electromagnetic environmental protection, and ensure the safe operation of the aircraft, these provisions are enacted according to the Civil Aviation Regulations of the People's Republic of China, the Regulation of Civil Aviation Administration (PRC), Hebei Provincial Measures on the Civil Aerodrome Obstacle Free Space and Electromagnetic Environmental Protection and other laws and regulations, combined with the actual situation in the city.
第二條 本市行政區(qū)域內(nèi)民用機(jī)場(chǎng)凈空和民用航空電磁環(huán)境保護(hù)適用本辦法。
Article 2: The civil aerodrome obstacle free space and electromagnetic environmental protection within this Municipality's administrative region would apply these provisions.
第三條 市人民政府和凈空保護(hù)區(qū)內(nèi)的縣（市、區(qū)）人民政府應(yīng)當(dāng)加強(qiáng)對(duì)民用機(jī)場(chǎng)凈空、電磁環(huán)境及安全保護(hù)工作的領(lǐng)導(dǎo)，將其納入本地安全生產(chǎn)責(zé)任目標(biāo)考核體系，建立完善工作責(zé)任制和聯(lián)席會(huì)議機(jī)制，研究解決工作中的重大問(wèn)題。
Article 3: The Municipal People's Government and the people's government of counties (county-level cities, districts) shall step up their leadership over the work of civil aerodrome obstacle free space and electromagnetic environmental protection, and shall incorporate them into the assessment system of local safety production responsibility targets, then shall establish and improve the work responsibility system and joint conference mechanism to study and solve major issues at work.
第四條 市民航行政主管部門(mén)負(fù)責(zé)機(jī)場(chǎng)凈空和電磁環(huán)境保護(hù)管理的綜合協(xié)調(diào)工作。
機(jī)場(chǎng)管理機(jī)構(gòu)依照本規(guī)定具體負(fù)責(zé)機(jī)場(chǎng)凈空和電磁環(huán)境的保護(hù)工作。
Article 4: The civil aviation administrative department shall be responsible for the overall coordination of civil aerodrome obstacle free space and electromagnetic environmental protection management.
The airport management agency shall be of the specific responsibility for civil aerodrome obstacle free space and electromagnetic environmental protection work in accordance with this provision.
凈空保護(hù)區(qū)域內(nèi)的市、縣（市、區(qū)）人民政府及其民航、行政審批、規(guī)劃、城管執(zhí)法、建設(shè)、國(guó)土資源、環(huán)境保護(hù)、公安、安全監(jiān)管、體育、氣象、無(wú)線電管理等有關(guān)行政主管部門(mén)應(yīng)當(dāng)按照各自的職責(zé)，依法做好民用機(jī)場(chǎng)凈空和民用航空電磁環(huán)境的保護(hù)工作。
Within the protection zones, the Municipality, counties (county-level cities, districts) people's government as well as their administrative department in charge of civil aviation, administrative examination and approval, planning, urban management law enforcement, construction, land and resources, environmental protection, public security, safety supervision, sports, meteorology and radio management, shall, in accordance with their respective functions and duties, do the work of civil aerodrome obstacle free space and electromagnetic environmental protection according to law.
第五條 民用機(jī)場(chǎng)所在地縣（市、區(qū)）人民政府和機(jī)場(chǎng)管理機(jī)構(gòu)應(yīng)當(dāng)加強(qiáng)民用機(jī)場(chǎng)凈空保護(hù)的宣傳、教育工作，提高公民的凈空和電磁環(huán)境保護(hù)意識(shí)。
Article 5: The people's government of the counties (count-level cities, districts) and the airport management agency at the places where civil airports are located shall step up the propaganda and education work and raise the citizens’ awareness on the civil aerodrome obstacle free space and electromagnetic environmental protection.
每年8月8日定為民用機(jī)場(chǎng)凈空和電磁環(huán)境保護(hù)宣傳日。市民航行政主管部門(mén)應(yīng)當(dāng)組織相關(guān)部門(mén)做好凈空保護(hù)宣傳、教育等活動(dòng)。
The Publicity Day falls on 8th of August each year, and to set up this day is to strengthen the publicity and education on the civil aerodrome obstacle free space and electromagnetic environmental protection. The civil aviation administration department in charge shall organize the relevant departments to do relevant publicity, education and other activities.
第六條 任何單位和個(gè)人不得破壞民用機(jī)場(chǎng)凈空和民用航空電磁環(huán)境。對(duì)破壞民用機(jī)場(chǎng)凈空和民用航空電磁環(huán)境的行為，任何單位和個(gè)人均有權(quán)制止，并向市民航行政主管部門(mén)或機(jī)場(chǎng)管理機(jī)構(gòu)舉報(bào)。
Article 6: No entity or individual can destroy civil aerodrome obstacle free space and electromagnetic environment. Every entity and individual has the right to stop any damage to civil aerodrome obstacle free space and electromagnetic environment and shall report it to the civil aviation administration department in charge of the Airport management agency.
第二章 凈空保護(hù)
Charter II Civil Aerodrome Obstacle Free Space Protection
第七條 機(jī)場(chǎng)管理機(jī)構(gòu)應(yīng)當(dāng)依照相關(guān)標(biāo)準(zhǔn)和經(jīng)批復(fù)的機(jī)場(chǎng)遠(yuǎn)期總體規(guī)劃，編制民用機(jī)場(chǎng)凈空和電磁環(huán)境保護(hù)區(qū)圖，征求相關(guān)部門(mén)意見(jiàn)后報(bào)民航華北地區(qū)管理局批準(zhǔn)，并及時(shí)報(bào)凈空保護(hù)區(qū)域內(nèi)縣級(jí)以上國(guó)土資源、規(guī)劃、環(huán)境保護(hù)行政主管部門(mén)和氣象主管機(jī)構(gòu)、無(wú)線電管理機(jī)構(gòu)備案。
Article 7: The airport management agency shall prepare maps of the civil aerodrome obstacle free space and electromagnetic environmental protection in accordance with relevant standards and approved airport long-term master plans. After seeking the opinions of relevant departments, they shall be submitted to Civil Aviation Administration of North China for approval as well as, to setup records in time, to the departments (above the county level) of land resources, planning, environmental protection administrative departments and meteorological authorities, radio regulatory agencies where the protection zone is located.
第八條 凈空保護(hù)區(qū)內(nèi)的縣級(jí)以上規(guī)劃行政主管部門(mén)應(yīng)當(dāng)將依法劃定的民用機(jī)場(chǎng)凈空保護(hù)和電磁環(huán)境保護(hù)區(qū)域納入當(dāng)?shù)爻鞘锌傮w規(guī)劃管理。
Article 8: The planning administrative department at or above the county level in the protection zone shall incorporate civil aerodrome obstacle free space and electromagnetic environmental protection zone into the overall planning and management of local cities.
第九條 凈空保護(hù)區(qū)內(nèi)的建設(shè)項(xiàng)目在審批前，應(yīng)當(dāng)由建設(shè)單位法人按照《華北地區(qū)民用機(jī)場(chǎng)凈空障礙物管理辦法》書(shū)面征求民航華北地區(qū)管理局或民航河北安全監(jiān)督管理局的意見(jiàn)。
Article 9: Before a construction project in the protection zone is examined and approved, the legal person of construction unit (investment party) shall ask for the written opinions of the Civil Aviation Administration of North China and/or the Civil Aviation Safety Supervision Administration of Hebei Province in accordance with the Measures for the Administration of Civil Aerodrome Obstacle Free Space in North China.
凈空試點(diǎn)期間，建設(shè)項(xiàng)目擬建高度不突破民航華北地區(qū)管理局批復(fù)的障礙物限制圖的，由所在地規(guī)劃部門(mén)會(huì)同機(jī)場(chǎng)管理機(jī)構(gòu)直接審批；擬建高度突破民航華北地區(qū)管理局批復(fù)的障礙物限制圖的，按本條第一款執(zhí)行。
During the pilot phase, if the proposed project height does not exceed the height limits set by the Civil Aviation Administration of North China, the local planning department and the airport management agency shall jointly approve directly. If the proposed project height exceeds the height limits, it shall follow the first paragraph of this article
對(duì)于規(guī)劃部門(mén)直接審批的機(jī)場(chǎng)凈空保護(hù)區(qū)內(nèi)的建設(shè)項(xiàng)目，規(guī)劃部門(mén)應(yīng)當(dāng)建立抄送機(jī)制，及時(shí)將已批準(zhǔn)建設(shè)項(xiàng)目的位置、海拔高度等信息通報(bào)機(jī)場(chǎng)管理機(jī)構(gòu)；機(jī)場(chǎng)管理機(jī)構(gòu)負(fù)責(zé)將項(xiàng)目審批情況向民航河北安全監(jiān)督管理局備案。
For the construction project within the restricted area which gets directly approval by the Planning department, the Planning department shall establish a copy-up mechanism to promptly notify the Airport management agency of the location and altitude of the approved construction project. The Airport management agency shall be responsible for transferring the examination and approval situations of the project to Civil Aviation Safety Supervision Administration of Hebei Province to set a record.
第十條 在凈空保護(hù)區(qū)內(nèi)，禁止從事下列活動(dòng)：
（一）修建超過(guò)民用機(jī)場(chǎng)凈空障礙物限制高度的建（構(gòu)）筑物或者其他設(shè)施；
（二）排放大量煙霧、粉塵、火焰、廢氣等影響飛行安全的物質(zhì)；
（三）設(shè)置影響民用機(jī)場(chǎng)目視助航設(shè)施使用或者飛行員視線的激光光束、燈光、標(biāo)志或者物體；
（四）在民用機(jī)場(chǎng)圍界外
（五）種植影響飛行安全或者影響民用機(jī)場(chǎng)助航設(shè)施使用的植物；
（六）施放風(fēng)箏；
（七）放飛影響飛行安全的鳥(niǎo)類動(dòng)物；
（八）飛行無(wú)人機(jī)、動(dòng)力傘、三角翼等通用航空器、航空運(yùn)動(dòng)器材的活動(dòng)；
（九）施放孔明燈等其他升空物體；
（十）燃放升空的爆竹、煙花、焰火等；
（十一）升放無(wú)人駕駛的自由氣球、系留氣球；
（十二）焚燒產(chǎn)生大量煙霧的農(nóng)作物秸稈、垃圾等物質(zhì)；
（十三）國(guó)家規(guī)定的其他影響民用機(jī)場(chǎng)凈空保護(hù)的活動(dòng)。
在民用機(jī)場(chǎng)凈空保護(hù)區(qū)域外從事前款所列活動(dòng)的，不得影響民用機(jī)場(chǎng)凈空安全。
Article 10: In the restricted area, the following activities are prohibited:
(1) The construction of buildings (structures) or other facilities that exceed the height limit of civil aerodrome obstacle free space;
(2) The emission of large amount of smoke, dust, flame and exhaust gases which will have adverse effect on the flight’s safety;
(3) To set a laser beam, light, sign or object which will affect the visual aids at the civil airport or the pilot's sight line;
(4) To build buildings (structures), plant trees or engage in activities such as excavation and accumulation of objects which will affect the operation safety of the civil airport at a distance of within five meters outside the boundary of the civil airport;
(5) To plant plants which will affect flight safety or affect the airfield facilities at civil airports;
(6) To fly kites;
(7) To release birds which will affect flight safety;
(8) To fly drones, powered umbrellas and delta wings and the like activities of general aircraft, aviation sports equipments;
(9) To discharge Kongming lanterns and the like objects which will blast off;
(10) To set-off firecracker, fireworks and so on;
(11) To lift up unmanned free balloon, tethered balloon;
(12) To incinerate crop stalks and garbage which will generate a large amount of smoke;
(13) Other activities prescribed by the state which will affect the civil aerodrome obstacle free space.
Engaging in the activities listed in the preceding paragraph outside the protection zone shall not affect the civil airport civil aerodrome obstacle free space safety.
第十一條 建設(shè)單位辦理機(jī)場(chǎng)凈空保護(hù)區(qū)內(nèi)建設(shè)項(xiàng)目竣工驗(yàn)收時(shí)，向負(fù)責(zé)驗(yàn)收的行政審批主管部門(mén)提供機(jī)場(chǎng)管理機(jī)構(gòu)出具的凈空保護(hù)區(qū)內(nèi)建（構(gòu)）筑物符合性認(rèn)可文件。
Article 11: The construction unit (investment party) shall submitted the Airport management agency’s certificate of conformity of the buildings (structures) in the Aerodrome Obstacle Free Space to the administrative department for the acceptance while handling the completion acceptance of the construction project in Aerodrome Obstacle Free Space.
行政審批主管部門(mén)應(yīng)當(dāng)根據(jù)機(jī)場(chǎng)管理機(jī)構(gòu)出具的建（構(gòu)）筑物符合性認(rèn)可文件組織驗(yàn)收，并將有關(guān)機(jī)場(chǎng)凈空保護(hù)驗(yàn)收情況及時(shí)通報(bào)機(jī)場(chǎng)管理機(jī)構(gòu)。
The administrative department should organize the inspection and acceptance in conformity with the building’s (structure’s) conformity certificate issued by the airport management agency, and should notify the airport management agency about the acceptance results.
第十二條 市民航行政主管部門(mén)應(yīng)當(dāng)會(huì)同規(guī)劃、建設(shè)、國(guó)土資源、環(huán)境保護(hù)等行政主管部門(mén)和機(jī)場(chǎng)管理機(jī)構(gòu)，根據(jù)國(guó)家有關(guān)規(guī)定劃定機(jī)場(chǎng)限制建設(shè)噪聲敏感建筑物的區(qū)域，并向社會(huì)公布。
Article 12: The municipal civil aviation administration should meet with the relevant departments such as planning, construction, land & resources, environmental protection and airport management agency to demarcate the boundaries of airfield area that restrict the construction of noise sensitive buildings in accordance with the relevant provisions of the state, and announce the boundaries of airfield area to the public.
經(jīng)批準(zhǔn)在機(jī)場(chǎng)限制建設(shè)噪聲敏感建筑物的區(qū)域內(nèi)建設(shè)噪聲敏感建筑物的，建設(shè)單位應(yīng)當(dāng)采取減輕、避免噪聲影響的措施。
The construction unit (investment party), which is with the approval of the constructing noise-sensitive buildings (structures) in the airfield area shall take measures to mitigate and avoid the influence of noise.
第十三條 市氣象管理機(jī)構(gòu)會(huì)同市民航行政主管部門(mén)確定升放無(wú)人駕駛的自由氣球、系留氣球的限制區(qū)域和高度，并向社會(huì)公布。
Article 13: The municipal meteorological administration should meet with the municipal civil aviation administration to determine the restricted area and height of the driverless free balloon and captive balloon, and announce the area and height to the public.
未經(jīng)審批，舉辦無(wú)人駕駛的自由氣球、系留氣球活動(dòng)的，由氣象主管機(jī)構(gòu)組織依法予以查處。
If the activities of driverless free balloon and/or captive balloon are held without approval, the municipal meteorological administration will punish in line with relevant laws and regulations.
第十四條 市體育行政主管部門(mén)會(huì)同市民航行政主管部門(mén)確定進(jìn)行動(dòng)力傘、滑翔傘、航空模型等航空體育運(yùn)動(dòng)的限制區(qū)域和高度，并向社會(huì)公布。
Article 14: The municipal sports administrative department should meet with the municipal aviation administration to determine the restricted area and height of air sports such as powered parachute, paragliding, aviation aerial model, and announce the area and height to the public.
未經(jīng)批準(zhǔn)，舉辦動(dòng)力傘、滑翔傘、航空模型等航空體育活動(dòng)的，由市體育行政管理部門(mén)組織依法予以查處。
If the air sports activities such as powered parachute, paragliding, aviation aerial model are held without approval, the municipal sports administrative department will punish in line with relevant laws and regulations.
第十五條 市、縣（市、區(qū)）、鄉(xiāng)（鎮(zhèn)）人民政府應(yīng)當(dāng)組織或協(xié)調(diào)相關(guān)部門(mén)對(duì)凈空保護(hù)區(qū)域內(nèi)排放大量煙塵、粉塵、廢氣，焚燒農(nóng)作物秸稈產(chǎn)生大量煙霧，放飛孔明燈，施放風(fēng)箏，燃放升空的爆竹、煙花、焰火等影響飛行安全的行為進(jìn)行監(jiān)督檢查，并依法查處。
Article 15: The people's governments of the Municipality, counties (count-level cities, districts) and townships (town) shall organize or coordinate the relevant departments in the clearance protection to check and supervise the activities affecting the flight safety in the protection zone, for instance, burning straw and producing a lot of smoke, flying Kongming lanterns, flying kites, setting off firecrackers, fireworks etc. and shall investigate and punish all kinds of illegal activities detrimental to the environment in accordance with the law with the focus on ensuring the flight safety.
第十六條 信鴿協(xié)會(huì)等組織應(yīng)當(dāng)做好協(xié)會(huì)會(huì)員、俱樂(lè)部等組織管理工作，教育和監(jiān)督其在放飛信鴿和組織競(jìng)翔比賽等活動(dòng)時(shí)，嚴(yán)格遵守機(jī)場(chǎng)凈空管理的有關(guān)規(guī)定，不得影響飛行安全。
Article 16: The Pigeon Association and other organizations shall do a good job of association and club management. When there is flying pigeon racing or other activities, the organization shall inform and supervise them to strictly abide by the relevant provisions of airport clearance management, and any activity that will possibly affect flight safety shall be prohibited.
第十七條 機(jī)場(chǎng)管理機(jī)構(gòu)應(yīng)當(dāng)采取綜合措施，防止鳥(niǎo)禽和其它動(dòng)物對(duì)航空器安全產(chǎn)生危害；發(fā)現(xiàn)鳥(niǎo)禽和其他動(dòng)物進(jìn)入民用機(jī)場(chǎng)飛行區(qū)內(nèi)，可能危及航空器運(yùn)行安全的，應(yīng)當(dāng)及時(shí)驅(qū)趕或者獵捕，必要時(shí)可以捕殺。
Article 17: The airport management agency should take comprehensive measures to prevent the birds and other animals doing harm to the safety of aircraft. If airport authority find that birds and other animals entering the civil airport flight area, which may endanger the safe operation of the aircraft, timely eviction or hunting, killing shall be operated when necessary.
第十八條 機(jī)場(chǎng)管理機(jī)構(gòu)應(yīng)當(dāng)建立日常凈空管理巡查制度，巡查中發(fā)現(xiàn)在凈空保護(hù)區(qū)域內(nèi)未經(jīng)批準(zhǔn)正在建設(shè)或已建成的影響飛行安全的障礙物時(shí)，應(yīng)當(dāng)及時(shí)報(bào)告市民航行政主管部門(mén)。市民航行政主管部門(mén)應(yīng)當(dāng)會(huì)同機(jī)場(chǎng)管理機(jī)構(gòu)組織相關(guān)部門(mén)對(duì)障礙物進(jìn)行專門(mén)的航行研究，并采取有效措施，消除安全隱患。
Article 18: The airport management agency shall establish a daily clearance area inspection system. If obstacles under construction or have been completed affecting the safety of flight are found in the protection zone, they ought to be reported to municipal aviation administrative departments promptly. The Municipal aviation administrative department shall conduct specialized Research on obstacles, and take effective measures to eliminate hidden dangers, in conjunction with the airport management organizations.
第十九條 機(jī)場(chǎng)管理機(jī)構(gòu)出具凈空保護(hù)意見(jiàn)的建設(shè)項(xiàng)目或凈空保護(hù)區(qū)及以外地區(qū)可能影響飛行安全的高大建筑物或者設(shè)施，產(chǎn)權(quán)人或管理人應(yīng)當(dāng)按照國(guó)家有關(guān)規(guī)定設(shè)置有民航許可證的障礙燈和標(biāo)志，并予維護(hù)管理，保證正常使用；發(fā)現(xiàn)障礙燈、標(biāo)志損壞，應(yīng)當(dāng)及時(shí)修復(fù)。
任何單位和個(gè)人不得阻止安裝障礙燈、標(biāo)志，不得影響障礙燈、標(biāo)志的正常使用。
Article 19: The airport management agency may issue clearance protection opinions and suggestions to those construction projects or facilities that may affect flight safety in or outside the protection zone. The property owner or manager shall set up the obstruction lights and signs with civil aviation certificates according to the relevant provisions of the state, and carry out regular maintenance of the signs to ensure the normal use of them. If the obstruction lights and damaged signs are found, they should be repaired in time.
No unit or no person may illegally interfere the installation of aviation obstruction lights and signs, or affect the normal working of the light and signs.
第二十條 在機(jī)場(chǎng)凈空保護(hù)區(qū)域內(nèi)設(shè)置22萬(wàn)伏以上（含22萬(wàn)伏）的高壓輸電塔的，應(yīng)當(dāng)按照國(guó)務(wù)院民航主管部門(mén)的有關(guān)規(guī)定設(shè)置障礙燈或者標(biāo)志，保持其正常狀態(tài)，并向民航華北地區(qū)管理局、民航華北地區(qū)空中交通管理局和機(jī)場(chǎng)管理機(jī)構(gòu)提供有關(guān)資料。
Article 20: When a high voltage transmission tower with more than 220 thousand volts (including 220 thousand volts) is set up in the airport protection zone, lights and signs should be set-up and normal state of them should be maintained according to the relevant provisions of department of civil aviation of the State Council. Meanwhile, the relevant information ought to be provided to the Civil Aviation Administration of North China, Air Traffic Control Bureau of Civil Aviation of North China and the airport management agency.
第三章 電磁環(huán)境保護(hù)
Chapter III Protection of Electromagnetic Environment
第二十一條 市無(wú)線電管理機(jī)構(gòu)應(yīng)當(dāng)會(huì)同民航華北地區(qū)管理局按照國(guó)家無(wú)線電管理的有關(guān)規(guī)定和標(biāo)準(zhǔn)確定民用機(jī)場(chǎng)電磁環(huán)境保護(hù)區(qū)域，并向社會(huì)公布。
Article 21: The municipal radio management organization shall determine the civil airport electromagnetic environment protection zone and announce it to the public, in conjunction with the Civil Aviation Administration of North China region according to the relevant national regulations and standards of the radio management.
第二十二條 禁止在民用航空無(wú)線電臺(tái)（站）電磁環(huán)境保護(hù)區(qū)區(qū)域從事以下活動(dòng)：
（一）修建架空高壓輸電線、架空金屬線、鐵路、公路、電力排灌站；
（二）存放金屬堆積物；
（三）種植高大植物；
（四）從事掘土、采砂、采石等改變地形地貌的活動(dòng)；
（五）修建影響民用機(jī)場(chǎng)電磁環(huán)境的建筑物或設(shè)施；
（六）國(guó)家規(guī)定的其他影響民用機(jī)場(chǎng)電磁環(huán)境的行為。
Article 22: The following activities are prohibited in the civil airport electromagnetic environment protection zone.
(1) Constructing overhead high voltage transmission line, overhead wire, railway, highway and electric power irrigation and drainage station;
(2) Storing metal accumulation;
(3) Plating tall plants;
(4) Doing activities that will change the landform, for instance, digging, sand excavation and quarrying;
(5) Constructing buildings or facilities that will affect the normal electromagnetic environment of civil airport;
(6) Other activities that will affect the normal electromagnetic environment of civil airport in national regulations.
第二十三條 在民用機(jī)場(chǎng)電磁環(huán)境保護(hù)區(qū)域內(nèi)設(shè)置、使用非民用航空無(wú)線電臺(tái)（站）的，無(wú)線電管理機(jī)構(gòu)應(yīng)當(dāng)征求機(jī)場(chǎng)管理機(jī)構(gòu)意見(jiàn)后，按照有關(guān)規(guī)定審批。
Article 23: If a civil aviation radio station is set up and used in the electromagnetic environment protection zone of a civil airport, the radio regulatory authority shall solicit the opinions of the airport management agency and issue permission in accordance with the relevant provisions.
第二十四條 任何單位或者個(gè)人使用的無(wú)線電臺(tái)（站）和其他儀器、裝置，不得對(duì)民用航空無(wú)線電專用頻率的正常使用產(chǎn)生干擾。
Article 24: The radio station and other instruments or devices used by any units or individual shall not interfere with the normal use of the special frequency of civil aviation radio.
第二十五條 民用航空無(wú)線電臺(tái)（站）受到其它非民用航空無(wú)線電臺(tái)（站）或者不明干擾源的有害干擾時(shí)，機(jī)場(chǎng)管理機(jī)構(gòu)和民航管理機(jī)構(gòu)應(yīng)當(dāng)立即采取排查措施，及時(shí)消除；無(wú)法消除的，應(yīng)當(dāng)及時(shí)通報(bào)市無(wú)線電管理機(jī)構(gòu)。市無(wú)線電管理機(jī)構(gòu)應(yīng)當(dāng)采取措施，依法查處。
Article 25: When the civil aviation radio station is subjected to harmful interference from other non-civil aviation radio stations or unknown interference sources, the airport management agency and civil aviation administrative authority should take immediate measures to eliminate them in time. If it can not be eliminated, the municipal radio administration organization should be notified in time. The municipal radio administration organization shall take measures to investigate punish them according to law.
第四章 法律責(zé)任
Chapter IV：Legal Liability
第二十六條 違反本規(guī)定第九條，建設(shè)項(xiàng)目所在地規(guī)劃部門(mén)在審批前未核實(shí)民用機(jī)場(chǎng)凈空保護(hù)要求造成超高的，應(yīng)當(dāng)立即采取措施，限期改正；情節(jié)嚴(yán)重的，根據(jù)《行政機(jī)關(guān)公務(wù)員處分條例》追究其行政責(zé)任；構(gòu)成犯罪的，依法追究其刑事責(zé)任。
Article 26: For those who violate Article 9, where the local planning department of the construction project has failed to verify the civil airport clearance protection requirements before approval and leads to the excessive height, immediate measures should be taken to correct it within a time limit. If the circumstances are serious, the administrative punishment will be given according to the regulations on the disposition of civil servants of administrative organizations; If a crime is constituted, its criminal sanctions shall be given according to law.
第二十七條 違反本規(guī)定第十條第一項(xiàng)規(guī)定的，由國(guó)土資源、規(guī)劃、城管執(zhí)法、建設(shè)行政主管部門(mén)依據(jù)職權(quán)分工，分別予以查處。
Article 27: For those who violate article 10 (1), punishment will be given by the department of land resources, urban planning, urban management law enforcement, construction administration, in accordance with their functions and powers according to the law.
第二十八條 違反本規(guī)定第十條有關(guān)規(guī)定，有下列行為之一的，依照《民用機(jī)場(chǎng)管理?xiàng)l例》的規(guī)定，由有關(guān)部門(mén)責(zé)令改正，情節(jié)嚴(yán)重的處20000元以上100000元以下罰款：
（一）違反本規(guī)定第十條第二項(xiàng)、第十二項(xiàng)規(guī)定的，由環(huán)境保護(hù)行政主管部門(mén)予以查處。
（二）違反本規(guī)定第十條第三項(xiàng)、第四項(xiàng)、第五項(xiàng)、第六項(xiàng)規(guī)定的，由民航行政主管部門(mén)予以查處。
（三）違反本規(guī)定第十條第八項(xiàng)、第九項(xiàng)、第十項(xiàng)規(guī)定的，構(gòu)成治安行政案件的，由公安機(jī)關(guān)予以查處。
（四）違反本規(guī)定第十條第十一項(xiàng)規(guī)定的，由氣象行政主管部門(mén)組織查處。
Article 28: For those who violate article 10 and have following behaviors, they will be ordered to make amends and be imposed a fine of more than 20000 Chinese Renminbi Yuan (hereinafter referred to as “CNY” and less than 100000 CNY, in accordance with the provisions of the administration of civil airports.
(1) For those who violate the Article 10 (2) & (12), they will be punished by the administrative department in charge of environmental protection;
(2) For those who violate the article 10 (3), (4), (5) & (6), they will be punished by the administrative department in charge of civil aviation;
(3) If it Constitute a public security administration case, for those who violate the article 10 (8), (9) & (10), they will be punished by the public security organization;
(4) For those who violate the article 10 (11), they will be punished by the meteorological administrative department.
第二十九條 違反本規(guī)定第十條第七項(xiàng)、第十六條的，在機(jī)場(chǎng)凈空保護(hù)區(qū)內(nèi)放飛信鴿等鳥(niǎo)類的，由市民航行政主管部門(mén)予以制止，并可處500元以上1000以下元罰款。
Article 29: For those who flying pigeons and other birds in the airport clearance area, violating article 10 (7) & (16), they will be stopped and imposed a fine of more than 500 CNY and less than 1000 CNY by the administrative department of civil aviation.
第三十條 違反本規(guī)定第十九條、第二十條的,障礙物產(chǎn)權(quán)人或管理人未保證障礙燈、標(biāo)志正常使用的，機(jī)場(chǎng)管理機(jī)構(gòu)下發(fā)整改通知后仍未改正的，由市民航主管部門(mén)責(zé)令限期改正；拒不改正的，對(duì)違反規(guī)定的個(gè)人處1000元罰款，對(duì)違反規(guī)定的單位處10000元罰款。
Article 30: For the owner or manager of the obstacle fails to guarantee the normal use of the obstacle instruction light or sign, they will be ordered to amend within the time limit by the municipal aviation administration department, if the rectification notice from the airport administrative agency are not effective. For those who refuse to correct and amend, individuals will be fined 1000 CNY and units and organizations will be fined 10000 CNY.
第三十一條 違反本條例第二十二條的規(guī)定, 依照《民用機(jī)場(chǎng)管理?xiàng)l例》的規(guī)定，由無(wú)線電管理機(jī)構(gòu)、民航行政主管部門(mén)、規(guī)劃、國(guó)土資源、城管執(zhí)法、建設(shè)等部門(mén)依據(jù)職責(zé)分工，責(zé)令改正；情節(jié)嚴(yán)重的，處20000元以上100000元以下的罰款。
Article 31: For those who violate article 22, they will be ordered to amend by the radio management organization, administrative department of civil aviation, urban planning and land resources department, urban management and law enforcement department, construction department and other departments in accordance with their functions and power following the regulations on the administration of civil airports. If the circumstances are serious, a fine of not less than 20000 CNY but not more than 100000 CNY will be imposed.
第三十二條 違反本條例第二十四條的規(guī)定，依照《民用機(jī)場(chǎng)管理?xiàng)l例》的規(guī)定，由市無(wú)線電管理機(jī)構(gòu)責(zé)令改正；情節(jié)嚴(yán)重的，處20000元以上100000元以下的罰款。
Article 32: For those who violate article 24, they will be ordered to amend by the municipal radio management organization following the regulations on the administration of civil airports. If the circumstances are serious, a fine of not less than 20000 CNY but not more than 100000 CNY will be imposed.
第三十三條 本規(guī)定第二十八條、第二十九條、第三十一條中涉及行政處罰措施，除專屬的行政處罰權(quán)外，相關(guān)主管部門(mén)可以委托鄉(xiāng)（鎮(zhèn)）人民政府、街道辦事處實(shí)施，并將委托內(nèi)容予以公告。
Article 33: For the article 28, 29 & 31, which are the administrative punishment measures in this provisions, relevant punishment can be authorized to the people’s government at county level and sub-district office for implementing by the competent departments, except the specialized administrative penalties. The content of authorization has to be published to the public.
第五章 附 則
Chapter V Supplementary Provisions
第三十四條 本規(guī)定所稱民用機(jī)場(chǎng)凈空保護(hù)區(qū)（簡(jiǎn)稱“凈空保護(hù)區(qū)”），是指機(jī)場(chǎng)遠(yuǎn)期規(guī)劃跑道劃定中心線兩側(cè)各
Article 34: The protection zone of the civil aerodrome obstacle free space (hereinbefore referred to as the “protection zone”) in this provisions refers to the area that within 10 kilometers of both sides of the long-term planning center line and 20 kilometers outside the runway end. It mainly includes clearance obstacle limits, the horizontal plane, airport electromagnetic environment protection zone and part of flight program protection zone.
本規(guī)定所稱機(jī)場(chǎng)電磁環(huán)境保護(hù)區(qū)，包括設(shè)置在機(jī)場(chǎng)總體規(guī)劃區(qū)域內(nèi)的民用航空無(wú)線電臺(tái)（站）電磁環(huán)境保護(hù)區(qū)和機(jī)場(chǎng)飛行區(qū)電磁環(huán)境保護(hù)區(qū)域。
The airport electromagnetic environmental protection zone mentioned in this provisions includes electromagnetic environment protection zone of civil aviation radio station and airport flight, which are designed and included in the overall planning area of the airport.
本規(guī)定所稱民用航空無(wú)線電臺(tái)（站）電磁環(huán)境保護(hù)區(qū)，是指按照國(guó)家有關(guān)規(guī)定、標(biāo)準(zhǔn)或者技術(shù)規(guī)范劃定的地域和空間范圍。
The electromagnetic environmental protection zone of civil aviation radio station in this provisions refers to the geographical and spatial scope defined in accordance with the relevant provisions, standards or technical specifications of the state.
第三十五條 本規(guī)定自
Article 35: The provisions shall come into force on December 1, 2017.
